Learning About the Lawsuit

4. What is this lawsuit about?

On April 29, 2026, a Class Action Complaint was filed against Cardinal Services, Inc. (“Cardinal” or “Defendant”) in the Superior Court for the state of Washington (King County).

The lawsuit alleges that the Personal Information of Class Members was accessed and stolen from Cardinal’s computer network on or about June 30, 2025 and August 8, 2025 (“Data Security Incidents”) as a result of Cardinal’s alleged failure to implement and maintain adequate data security safeguards.

Cardinal denies the allegations in the lawsuit and wrongdoing of any kind.

5. Why is there a Settlement in this lawsuit?

The Settling Parties have agreed to settle, which means they have reached an agreement to resolve the lawsuit. Both sides want to avoid the risk and expense of further litigation.

The Settlement is on behalf of the Plaintiffs who brought the case and all members of the Settlement Class, which includes all individuals residing in the United States who were impacted in the Data Security Incidents. In total, there are approximately 142,000 individuals in the Settlement Class.

The Court has not ruled in favor of either side. The Settlement is not an admission of wrongdoing by Cardinal.

6. What happens next in this lawsuit?

The Court will hold a Final Approval Hearing to decide whether to approve the Settlement. The hearing will be held at:

Where: Superior Court for the State of Washington (King County), 516 Third Ave., Courtroom W-719, Seattle, WA 98104.

When: 11:00 A.M Pacific Time on January 8, 2027.

Because the settlement of a class action decides the rights of all members of the proposed class, the Court must give final approval to the Settlement before it can take effect. Payments will only be made if the Court approves the Settlement.

You don’t have to attend the Final Approval Hearing, but you may at your own expense. You may also ask the Court for permission to speak and express your opinion about the Settlement (if you want to object to the settlement, see below for information on how to do that). If the Court does not approve the Settlement, it will be void and the lawsuit will continue. The date of the hearing may change without further notice to members of the class. To learn more and confirm the hearing date, visit question 6.

Learning About the Settlement

7. What does the Settlement provide?

Cardinal has agreed to establish an $850,000 fund (the “Settlement Fund”). Before payments are made to Class Members, the Settlement Fund will be used to pay for: Attorneys’ Fees and expenses awarded by the Court (Class Counsel will request no more than one-third of the Settlement Fund); Service Awards to the Class Representatives (up to $3,000 each); and the costs of administering the settlement.

The money remaining after those payments are made is called the “Net Settlement Fund.”

Any remaining funds after all deductions and disbursements to Class Members have been made will be sent to the Legal Foundation of Washington as a cy pres distribution.

(1) Credit Monitoring: All Settlement Class Members shall be offered two (2) years of single-bureau credit monitoring which will include $1 million in identity theft protection insurance, among other features.

(2) Reimbursement for Out-of-Pocket Losses: Settlement Class Members may submit a claim, with documentation, for up to $5,000 in out-of-pocket losses. Examples of documented Out-of-Pocket losses include unreimbursed losses related to fraud or identity theft, as well as credit monitoring expenses incurred between the time of the Data Security Incident and the time you submit your claim. Other eligible expenses may include postage, copying, scanning, faxing, mileage and travel-related charges, parking, notary and research fees, and certain phone-related costs such as cell phone charges billed by the minute, long distance calls, data charges billed by usage, and text message charges billed per message. You may also claim bank fees, accountant fees, and attorneys’ fees. All expenses must be directly connected to the Data Security Incident and cannot already have been reimbursed by another party

(3) Pro Rata Cash Fund Payment: Settlement Class Members may submit a claim for a pro rata share of the Net Settlement Fund, meaning each eligible Claimant receives an equal portion, estimated to be approximately $50.00. The value of the Pro Rata Cash Fund Payment depends on the number of timely and valid claims and will be calculated after payment of valid and timely claims for Out-of-Pocket losses and Credit Monitoring Services. The pro rata payment may be increased or decreased to exhaust the Net Settlement Fund.

The deadline to submit a Claim Form is December 17, 2026.

Members of the Settlement Class will “release” their claims as part of the settlement, which means they cannot sue Cardinal for the same issues in this lawsuit. The full terms of the release can be found at the Settlement Website.

8. How do I know if I am part of this Settlement?

You are a Settlement Class Member if you reside in the United States and your Personal Information was impacted in the Data Security Incidents.

Excluded from the Settlement Class are (i) Defendant (ii) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; and (iii) any judges assigned to this case and their staff and immediate family.

9. How much will my payment be?

Each Settlement Class Member who submits a timely and Approved Claim Form will be eligible to elect to receive Credit Monitoring Services, compensation for Out-of-Pocket Losses (must show documented proof of losses), and a pro rata share of the Net Settlement Fund, estimated to be approximately $50.00 per person. The actual payment amount will depend on the total number of Approved Claims submitted. Each Settlement Class Member may submit only one claim.

How to Get a Payment by Submitting a Claim

12. How do I get a payment if I am a Settlement Class Member?

If you wish to receive benefits, you must submit a completed Claim Form through the Settlement Website here or via U.S. mail to the Settlement Administrator at: Cardinal Services Data Settlement Administrator, P.O. Box 3274, Baton Rouge, LA 70821.

Your Claim Form must be submitted online or postmarked by December 17, 2026.

13. Do I have a lawyer in this lawsuit?

In a class action, the court appoints class representatives and lawyers to work on the case and represent the interests of all the class members. For this settlement, the Court has appointed the following individuals and lawyers.

Your lawyers: Kaleigh N. Boyd of McNaul Ebel, Jeff Ostrow of Kopelowitz Ostrow P.A., John Nelson of Milber PLLC, and Leanna A. Loginov of Shamis & Gentile, P.A. These are the lawyers who negotiated this Settlement on your behalf.

If you want to be represented by your own lawyer, you may hire one at your own expense.

14. Do I have to pay the lawyers in this lawsuit?

Lawyers’ fees and costs will be paid out of the Settlement Fund, as approved by the Court. You will not have to pay the lawyers directly.

To date, your lawyers have not been paid any money for their work or the expenses that they have paid for the case. To pay for some of their time and risk in bringing this case without any guarantee of payment unless they were successful, your lawyers may request, as part of the final approval of this Settlement, that the Court approve a payment of up to one-third of the Settlement Fund.

Lawyers’ fees and expenses will only be awarded if approved by the Court as a fair and reasonable amount. You have the right to object to the lawyers’ fees even if you think the settlement terms are fair.

Your lawyers will also ask the Court to approve a payment up to $3,000 to each of the Class Representatives for their time and effort they contributed to the case. If approved by the Court, this will be paid from the Settlement Fund.

Opting Out

15. What if I don't want to be part of this Settlement?

You can opt out of the Settlement. If you do, you will not receive any payment and cannot object to the Settlement. However, you will not be bound or affected by anything that happens in this lawsuit and may be able to file your own case.

16. How do I opt out?

To opt out of the Settlement and be excluded from the Settlement Class, you must mail your Request for Exclusion by December 9, 2026 to the Settlement Administrator at:

Cardinal Services Data Settlement Administrator
P.O. Box 3274
Baton Rouge, LA 70821

Such request for opt-out must be made in writing and contain:

(1) The case name (Lillian Derry, et al. v. Cardinal Services, Inc. 26-2-14262-9 KNT (Washington State Superior Court for King County));

(2) Your full name and current address;

(3) A statement indicating your request to be excluded from the Settlement Class; and

(4) Your physical signature as a Settlement Class member.

Mass or class opt-outs will not be accepted. Each individual wishing to opt out must submit a separate, personally signed request.

Objecting to the Settlement

17. What if I disagree with the Settlement?

If you disagree with any part of the Settlement (including the lawyers’ fees) but don’t want to opt out, you may object.

You can ask the Court to deny approval by filing an objection. You must give reasons why you think the Court should not approve it and say whether your objection applies to just you, a part of the Class, or the entire Class. The Court will consider your views. You can’t ask the Court to order a larger or different settlement; the Court can only approve or deny the Settlement—it cannot change the terms of the Settlement. If the Court denies approval, no Settlement payments will be sent out and the lawsuit will continue.

Any objection to the proposed Settlement must be in writing. You may also appear at the Final Approval Hearing, either in person or through your own attorney. If you appear through your own attorney, you are responsible for paying that attorney.

The Court can only approve or deny the Settlement Agreement; it cannot change its terms. You may, but are not required to, hire your own lawyer to assist you in objecting.

To object, you must submit a written objection to the Settlement Administrator, Settlement Class Counsel, and Defendant’s Counsel that includes:

(1) The objector’s full name and address;
(2) The case name and docket number – Lillian Derry, et al. v. Cardinal Services, Inc., No. 26-2-14262-9 KNT (Washington State Superior Court for King County);
(3) Information identifying the objector as a Settlement Class Member, including proof that the objector is a Settlement Class Member (e.g., copy of the objector’s settlement notice, copy of original notice of the Data Security Incident, or a statement explaining why the objector believes he or she is a Settlement Class Member);
(4) A written statement of all grounds for the objection, accompanied by any legal support for the objection the objector believes applicable;
(5) The identity of any and all counsel representing the objector in connection with the objection;
(6) A statement whether the objector and/or his or her counsel will appear at the Final Approval Hearing; and
(7) The objector’s signature.

Your objection must be emailed or postmarked on or before December 9, 2026.

Your Objection should be sent to:

Doing Nothing

18. What are the consequences of doing nothing?

If you do nothing, you will not get any money, but you will still be bound by the Settlement and its “release” provisions and all related Court orders. That means you won’t be able to start, continue, or be part of any other lawsuit against the Defendant about the issues in this case. A full description of the claims and persons who will be released if this Settlement is approved can be found in the Settlement Agreement here.
